From the facts stated, you should not hand over the gold to the opposite party’s lawyer without any written acknowledgment or legal record. Doing so may create disputes later and it will be difficult to prove the delivery of the items. In matrimonial settlements, exchange of jewellery, money or other articles should always be properly documented. The safest course is to either: • Record the return of the gold in the mutual divorce settlement agreement (Memorandum of Understanding), clearly mentioning the quantity and description of the jewellery, or • Hand over the gold before the court at the time of filing or recording of the mutual consent divorce, so that it becomes part of the court record, or • Provide it only against a written acknowledgment/receipt signed by the concerned party. Handing over valuables to a lawyer without written proof is not advisable and carries legal risk. Therefore, ensure that the return of the gold is properly documented and preferably done through court proceedings or a written settlement to avoid any future allegations or disputes.
