Gift deed or cancellation deed of Purchased Property

Sir, I filed divorce, my wife filed domestic violence in which she claimed right of residence, she is earning 50000 salary & we have no child she suppressed job income before court, given false affidavit in court. I filed application for 340 IPC. I purchased property jointly with my live in relation partner name & me. If this property information known to my wife & she produced documents in court, whether wife will get residence rent money. To avoid shall I gift my share to live in partner

Hi Good Afternoon, In your case your wife file dv against you and she claim right of residence. first of all very important factor of your case is whether you living in that propery or not, if yes then straight a way sell that property. do not make any gift deed. even court can has power to restraint that property. so if you make gift deed then prima facie it observed that you did it intentionally to overcome the issue. and court can pass order in favor to her. for more details and querries kindly contact us and visit our website.
