Getting NOC from spouse to travel with the kid out of country

I am a mother of 6 year old girl. Do I need the NOC from the spouse to travel with the kid out of country as my divorce case is still pending in the court and the child custody hasn't been decided yet.

If the divorce case is pending and the custody of the child is not decided then you need to seek permission from the court to take the child alongwith you with an undertaking to court to return back. mam as you said you need to travel with kid and ur divorce is pending in this case we need to complete the formalities do as per court nothing can be illegal and no body can blame you in any condition.

You have to apply to the concerned court by submitting an undertaking. The court has discretion to send a notice to your husband regarding the same. And then the court will grant permission and the NOC is not required from your husband.
