Found Photos of Wife with a Man Online on a Website

20-Feb-2026 (In Divorce Law)
I recently found photos of my wife hugging and kissing some guy on internet with very offensive and derogatory remarks about her. I was thinking of using them in court cases against me. But the photos have been deleted since then. Is it advisable for me to use those photos in court alleging adultery along with the screenshot of the post with highly derogatory remarks against her. I don't know who has posted them or their genuineness. Will it help me in anyway or instead her in getting sympathy.

Something that is in public domain or was in public domain can be used in the court of law without there being any repercussions for the same. Contact the particular website and get that video. Just a question though what were you doing on that website??

Using deleted internet photos or screenshots from an unknown source to allege adultery is legally weak and risky. If you cannot establish authenticity, source, and proper electronic proof, the court is unlikely to rely on them. Mere hugging or kissing photographs, even if genuine, generally do not by themselves prove adultery; the standard is much higher and requires clear evidence of a voluntary sexual relationship. Since you do not know who uploaded the content or whether it was edited or morphed, it can easily be challenged as fabricated. Filing such material with derogatory remarks may also backfire and allow the other side to claim harassment, defamation, or misuse of private content, which could strengthen her case instead of yours. Practically, unless you can independently verify and legally prove the material through proper technical evidence, relying on it is more likely to damage your credibility than help your case.

You can use screenshots and forensic recovery to prove the deleted content. Under Section 14 of the Family Courts Act, courts have wide discretion to admit evidence even without a strict 65B/63 BSA certificate to determine the truth. However, ensure your allegations are substantiated; using derogatory remarks about her character without solid proof can backfire, as courts may view it as mental cruelty against the wife.

Hi there, in general such evidence is of crucial importance. However, regarding the veracity of the photos they stand on a weak ground as the court generally verifies the source of the picture. In your situation what you should do is get a good lawyer who can argue firmly regarding the authenticity of the pictures and thereupon it will fall in your favour. It can certainly help you if you just use the pictures. You can seek divorce on grounds of adultery. While sympathy and sharing indecent pictures could be an issue but once the court allows it will certainly help your case.
