yes, you can file for divorce and can ask for maintenance if you are unemployed or unable to sustain yourself. But you must be handy with all evidence before filing the case for divorce or else your case may be dismissed for lack of evidence. For further queries do consult me.

There are multiple ways for redressal of your problem. If you do not want to live with your husband then you can file a divorce suit alongwith a prayer for interim maintenance. After your case gets disposed of, the court will grant you divorce and permanent alimony in shape of money from your husband. Now, one more solution for your problem is, you can ask for judicial separation. In judicial separation you will not be granted divorce, but you will be allowed by the court to stay away from your husband. You can also ask for a interim maintenance as well during the judicial separation. You can also file cases under domestic violence act. So there are many ways you can get relief from the court. It totally depends upon you as to what you want. For further legal advice contact our team. We will be happy to help you.

If your spouse is cheating on you and you do not want to stay with her anymore immediately file for a divorce as if you keep it pending she may file counter cases on you which will be detrimental to you. I recommend that you opt for one time settlement i.e. alimony instead of maintenance as it will reduce you any future problems.

If a spouse is cheating (having an extramarital affair), the Hindu Marriage Act, 1955 (HMA) provides specific legal remedies. Here’s a detailed guide: Legal Ground – Adultery is a valid ground for divorce. If one spouse has voluntary sexual intercourse with any person other than his/her spouse, it is considered adultery.
