As far as the property is concerned you don't have any rights upon the property of your father-in-law. You can always file a petition under the DV Act to claim a separate accommodation and also a monthly maintenance for yourself as well as for your children from your husband. And if the situation is not good then you can always file a divorce petition in the court under cruelty grounds. I would suggest you to go for mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Dear ma'am Unfortunately you cannot claim a share in the property which is registered in the name of your father in law. However, you may claim residence orders to stay in the property till the disposal of your case. Moreover, you can claim maintenance for you and your kids from your husband payable by him on a monthly basis. It's better to lodge an FIR against your husband under Sec. 498A IPC before you file any case as it will give you an upper hand while negotiating with your husband for alimony. Eventually he will come around and settle for a handsome alimony to you. If you need more assistance on that you may consult me. Good luck!

It’s the sole responsibility of your husband to maintain your child n you and not this in-laws! If you are earning handsome amount then court may not pass maintenance. Any type of divorce is not good but if things are beyond inhumanity then one must go for mutual one ! B in touch
