filing mutual divorce petition and listing after withdrawal

we filed mutual consent divorce on 5th august 2021. but court want that it will be numbered only after we withdraw divorce petition already filed by me on 2nd january ,2021. is is correct. do we need to withdraw divorce petition before mutual consent petition be numbered .

Yes, the court is right. First you need to withdraw the divorce petition which is a contested route. Then only you can file petition for divorce by mutual consent. Otherwise there will be two petitions for same relief which is not permitted. Before withdrawal make sure that both parties are willing for mutual consent divorce.
