If the husband as well as the wife have mutually decided to end their marriage, both can jointly file a mutual consent divorce petition before the Family Court, agreeing with all the terms and conditions relating to the rights of both the parties post divorce. One year of period has not even elapsed as You got married in last December. To obtain divorce by mutual consent it is a pre requisite that party should stay separately for one year but in your case it is impossible to meet the condition for now. Other possibilities are required to be explored to obtain seek separation.

you can file for divorce if you both are agreed ending the marriage mutually if the wife cannot come to India for filing the divorce she can simply give a power of attorney in her name to someone else the court will grant you divorce
