Filing a Divorce case against Cruely

My wife has been mentally harrassing me from past 8 years, We are married since last 11 years & have one 8 Year Son. She & her family had been a stranger to me since marriage as such they had been hiding things from me. Now recently i came to know they all are booked under IPC 1860-498-A, 307,34,DOWRY PROHIBITION ACT, 1961 SECTION- 4 by their daughter in Law . Which is now over my head as My Family reputation is in jeopardy of such heinous act . Their family members are also misguiding my only son by feeding wrong informations & i am very concerned about my son's brought up & Future. KIndly advice how should i proceed for Divorce without loosing my Family & mine reputation.

File your divorce under section 13 (1) of the Hindu Marriage Act, 1955. There are several grounds mentioned there in which you can aver in your petition along with the facts of your case.
.
Prove in court that she has been harassing you mentally and treating you with cruelty.
There is no consummation of marriage.

If the Inlaws or wife files a Dowry harassment case before Police Authorities , it may not be condidered as if your Family's reputation shall be in jeopardy , but yes , on the basis of such a Criminal Complaint or FIR , if the Police start taking penal actions, like arresting the husband or any other family members , it can be a very serios issue ..... and under such circumstances , you or the concerned family members must take anticipatody Bail from the Court.

And , if your in laws start spreading false rumors among family or in the society , you may consider filing defamation case against the concerned person(s) .....

And you may also straight away file a Divorce case in the concerned Family Court, on the ground of cruelty, the lasest Criminal case / FIR, being another instance of cruelty by the wife, on you. ...
