If your partner is deliberately avoiding to consummate, and despite of your efforts things are not going in a way of fruitful relationship then you can file for divorce on the ground of irreparable breakdown of marriage under section 14 of HMA prior 1 year.

Hi No divorce can be filed before 1 year of marriage is completed. However, you may file for an annulment of marriage based on the grounds available under the relevant laws. Feel free to get in touch if you would like to discuss further. Regards Adv. Abhinav Sharma

According to section 14 of Hindu Marriage Act no petition can be filed unless 1 year has lapsed from the date of marriage. But in the same section it is also mentioned that in exceptional cases where is no cohabitation between the parties the parties can always apply for divorce. For more legal assistance I am just a call away.

We need more facts on your case that which religion do you belong to because divorce pattern is different as per the religion ….for instance if you belong to Hindu religion then you have to follow the Hindu marriage act 1955 for your divorce, in case if your wife is agree for mutual divorce then this period of one year and waiting period of six months can be exempted by showing the compulsions in the marriage or exceptional hardship ..please be in touch with us with more facts …thank you
