False promises at the time of marriage can I file divorce now

my husband works in private chit fund company draws a salary about 20000 but gave a false promise of 45000 salary during marriage. in that 20000 there is no way to living as there is more expense for car emi,rent etc if i need to file divorce they dont have any property as they have lost everything i have a 2 months baby please help can i approach court for peaceful living with my husband please help can i claim from him some amount monthly through court
Madam yes, you can file a maintenance Petition under section 125 for maintenance of yourself and your baby, or you can also file under domestic violence and get maintenance, further if you want to get divorce then you have to prove certain things that is cruelty or desertion and then the court will grant divorce or you can go for mutual consent divorce by entering into a compromise.

You need to take a very strong decision before going for a divorce and file a case for your and your child's maintenance. If you still think you can continue with your husband you can file a petition for restitution of conjugal rights in case you have separated and are not staying together anymore.
