False Domestic violence case filed by wife in police station

Wife had lately (march 2025) started psychiatric medicines and left the course halfway. Previously wife was housewife. Then suddenly took unilateral decision (june 2024) to join job disturbing family set-up. Wife not follow Counsellor suggestion also. She then want me to spend for her personal expenses also. I did not agree. She now file false DV case in police station against me and family members. Police send notice to me n family to submit statement/evidence. How to deal? Will police arrest?

Initially the Police will investigate the matter before filing of an FIR. If an FIR is already filed then they shall vide a notice and are only trying to investigate in order to file the chargesheet. Feel free to contact me for seeking any legal advice as regards the same.

if you don't appear to the police then they will keep it in record and as per law Magistrate will be issued non bailable warrent after that you and all accused will get the bail but for that you need to appear in the court better you share the FIR copy according to that you will get advice

Police does not arrest in DV cases. However the police may arrest if an FIR is registered with a police station against you. Well, you have to remain quite cautious in getting your Statements and evidences recorded before Police! If either any mistake occurs or you fail to submit evidences in your favour, there are chances, that, negative chargesheet may be filed against you, which may get you arrested in future.

domestic violence case is quasi criminal in nature. you need to hire a lawyer to help u in filing a detailed statement and reply to all the allegations made by your wife and vice versa u can also file for a divorce if u don't wish to continue the relationship.
