FALSE CRPC 125 filed - Objection filed on both interim & final

My wife has registered a false CRPC 125 case against me last year March 25th 2021. I have changed the 1st lawyer since I didn't find the seriousness. The second one also is not satisfactory. My wife has demanded Rs 40000 as interim maintainance and I am jobless with no savings, just alive on mother's pension. This all she has done just after 2 months of my father's death on January 2021. My mother is 65 year old and old school type, she is afraid that we will come to road, since my wife is money lover and loves easy ways of income. I have a baby boy who is 1 year old and he is with her. Soon after our marriage she started fights on small small issues and used to black mail me of police complaints and 498A etc which I was completely unaware. She never ever stayed with my parents. Even after our marriage just after 4 days me and my wife went to Bangalore and were leading independent life. But still she used to fight on petty issues. And used to take huge money from me. What should I do?

you have two option. first make an application before the trial magistrate explaining your predicaments under the changed circumstances and get the maintenance amount modified. second option is to approach the high court in its revisional jurisdiction and seek quashing of the proceeding.
