False complaint filed by friend's wife, wants to take divorce from her

he has taken bale by court and she came back home. she is not willing to take back case. he is not willing to stay with her because she has made his life miserable. now charge sheet submitted to court by police. he has 10 year old male kid. 1. can he give one more complaint against law regarding mental harasement. 2.can he go to advocate and send diverse notice 3.can he force her to go away from his own house 4. how can he get rid of from his wife without damaging his status

Yes, off course
Your friend can get separated from his wife.

He can surely send a divorce notice to his wife.
And then
He can file a divorce petition in the court on the grounds of cruelty.

And finally if needs the custody of his child, he can claim his custody also in the same petition or else through a separate petition.

If the charge sheet is submitted by the police than he has to contest the matter at concerned court and wait for judgement. When the already the case is filed by her against him and case is pending then what complaint he want to file against her, even if he want what is the proof he possess to prove his allegation against her. It should be handled by consulting the advocate. Instead of forcing her to leave the house he can leave separately and file divorce case against her on the ground of cruelty and seek divorce. On what case he has obtained bail is not mentioned by him it must be 498-A. Anyway tell him to contact advocate.

If she filed dowry harassment case or domestic violence case you file judicial separation case seeking court permission to live separately from your wife. sometime court will not grant divorce, but you can seek judicial separation with the details of her case
