False affidavit in 125 case filed by wife by mentioning she is not wor

OP earning 1.28 lakhs per month and showed in her petion that she is not working and filed false affidavit. Till now interim is not passed. I want to know at what stage should i move 340 application? and will court hear 340 first before deciding on 125 case

You can go for 340 CrPC/379 BNSS at any stage. If you have evidences of her earning that much like her Income Tax Return, Salary Slip, form 16 or anything, immediately file 340CrPC/379BNSS. Also, file those documents in your reply of Interim maintenance. It will help the Judge in deciding the right amount.

dear client as per your query I can only suggest that as you have discussed that she has given a false statement in petition what about the status of rajneesh vs Neha affidavit is she saying same in that also if yes then definitely go for 340 application for future paid consultation please contact us with your relevant documents.
