Exclusion of Mediation in Mutual consent Divorce

18-Jun-2024 (In Divorce Law)
Hi, I filed a contested divorce and he filed RCR . As part of RCR, mediation was referred, and an agreement was entered into regarding child custody, child alimony and other terms and conditions. I withdrew contested divorce and together we are going to file a mutual consent now. Advocates are bringing in mediation again . Is mediation a mandatory process in mutual consent too or can it be avoided? Pls confirm.

It is not mandatory in your particular case because you have already filed for a contested  divorce and withdrew it for the purpose to seek a mutually divorce. You must mention this reason in the waiver petition; however, the Hon'ble Family Court has complete discretion to decide.
