Ex-husband reopening case after decree of divorce as he was oversees.
09-Jan-2023 (In Divorce Law)
Granted divorce after hearing one side and now the ex-Husband trying to reopen the case stating that he was overseas during the case. Will it nullify the granted divorce ? Also is there any way that the lady needs to pay compensation after getting divorced.
the husband can approach the court for setting aside the exparte order and proceed with the case by adducing evidence on his side if any. there is no case of compensation by the lady after getting dicorced.
Ex-party decisions and decrees are bound to be set aside so that decisions could be decided on merits. There is no question of the wife being required to pay compensation. On the contrary, while allowing the matter to be reinstated, it is likely that the court may impose some cost on the husband.
