Evidence Affidavit and Income Affidavit

Income Affidavit -- Lied to court . Shall we wait for the Evidence affidavit filing or we can bring in the notice of the court about hidden facts of Income Affidavit> Please help in this regards.

You can always argue regarding the wrong income affidavit at the time of interim arguments regarding the maintenance. These arguments should be held before the maintenance is allowed by the court. For more legal assistance I am just a call away.

Lying categorically on affidavit furnished in court amounts to commission of offence of perjury punishable under Sec. 340 of the Cr.P.C. All you need is a good counsel to draft an application in that regard which would solve your problem. For efficacious remedial action, you may consult me.

Dear client In case of proof of the misrepresentation given in court. You may file an application under section 340 as the court is duty bound to grant a decree of maintenance as per Rajnesh v Neha (the income affidavit filed before the court) Feel free to get in touch to discuss further

In such circumstances you can file an appropriate application along with all documentary proof that the statement given under oath before the court are false and wrong. On the said application court will take necessary action against him.

you may bring it to the courts notice immediately. filing a false affidavit and deposing false facts therein is a punishable offence. as such it's better if it's pointed out immediately before the court.
