Dv case - whether to approach NCW or file FIR.

28-Jul-2023 (In Divorce Law)
I was mentally tortured by my husband and inlaws from past few months back, even my husband left me alone and went back to his parents house with all his belongings. And threatened me for a mutual divorce. When I begged to reconcile he said I have to sign a paper that had many allegations on me only and if any fight happens in future we will go for mutual separation. Iam very tensed, whether to go to NCW and then file and FIR or what to do please help

if you have been tortured and you have proof of that it would suffice for you to initiate a criminal case against the accused. if you don't have any proof then you can seek protection order and residence order under pwdv act. ncw may or may not be approached. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate Hon'ble High Court, Calcutta.
