Agar summons par “Refused” likha hua hai, to law me generally usko valid service maana jata hai. Dusri date par Court usually wife ki appearance check karega. Agar wo present nahi hoti, to Court ex-parte proceed karne ki direction de sakta hai ya final opportunity de sakta hai. Aapko next date par process server ki report, postal receipt/tracking aur refusal endorsement properly record par lana chahiye. Agar Court satisfied ho gaya ki jaanbujhkar summons refuse kiya gaya hai, to written statement ka chance limited ho sakta hai aur matter petitioner evidence ki taraf badh sakta hai. Exact stage Court ki satisfaction aur local practice par depend karegi.

Dear Client, DV case jo file hua he, uska status kya he? Is it dismissed or is it still pending. Also divorce petition me jo aapke wife ko summons mila he uska response refused likha he? Yaane most probably she won’t co-operate. However will still need more details to analyse the situation at hand

Refusal is a good service. If your wife fails to appear in person or through an Advocate the your case shall proceed ex parte. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Agar summons “refused” mention hua hai, to court valid service maan sakta hai. Next date par wife absent rahe to ex-parte proceedings ya fresh service/order ki stage aa sakti hai, as per the concerned provisions of law

Refusal of summons is legally considered as valid service. On the next date, the court will note the 'Refused' remark and declare the service complete. If your wife fails to appear in court on that second date, the judge will likely pass an order to proceed ex-parte against her, and the case will then be listed for your ex-parte evidence.
