What is the punishment for domestic violence act case. Not BNS 85.

Provisions of Domestic Violence Act is not punishable. Wife claim various kind of reliefs from husband. Like maintenance, right to reside in matrimonial home, prevent husband to alginate his property and claim share in the property.

A Domestic Violence Act case is mainly civil in nature and has no direct punishment. Jail up to 1 year or fine up to ₹20,000 may apply only if a court's protection order is violated (Section 31, PWDV Act).

If the protection order is passed by the magistrate and the respondent does not oblige to it, then for breach of protection order respondent shall be punishable imprisonment which can extend to 1 year, or with fine upto 20k or both.

The Protection of Women from Domestic Violence Act, 2005 (PWDVA) is primarily a civil/protective law and does not itself prescribe imprisonment as the punishment for domestic violence. The Magistrate may grant reliefs such as protection, residence, monetary relief, custody, and compensation. Breach of a protection order or interim protection order is a criminal offence under Section 31, punishable with imprisonment up to 1 year, or fine up to ₹20,000, or both. Other criminal offences, if separately established, may attract punishment under the applicable penal law.
