The Protection of Women from Domestic Violence Act, 2005 (PWDVA) is primarily a civil/protective law and does not itself prescribe imprisonment as the punishment for domestic violence. The Magistrate may grant reliefs such as protection, residence, monetary relief, custody, and compensation. Breach of a protection order or interim protection order is a criminal offence under Section 31, punishable with imprisonment up to 1 year, or fine up to ₹20,000, or both. Other criminal offences, if separately established, may attract punishment under the applicable penal law.
