Domestic Violence by husband and in-laws and Maintenance for my kid

Hi, My husband married me in a rape case. From the day of the marriage, he and his parents started torturing me for taking back the rape case. It's been 4 years the case is still going on. Even after marriage, he used to hit me along with his mother. I had to file 498A twice, but everytime he and his parents used to sweet talk with the police and say that we will not repeat the things and we will take care of her. I became pregnant and had a baby girl. They left me in the hospital and ran off. And then 11 months after the gurl is born, my husband took is back because the rape case is still going on and I said we are not living together . After a month, they started hitting me again. This I cane iut of the house for good. It 's been 2 years since he had contacted me or seen my baby's girl. Can I get maintenace in this situation

Certainly yes. Maintenance is basic right for any woman. You can file for maintenace, and divorce case on ground of desertion. In case you want to live with him; you can also file restitution of conjugal rights.

Yes u can file maintenance case u/s 125 CrPC or monetary relief under domestic Violence case! You need to hire an advocate in this regard and do certain homework before filing the complaint case ..b in touch

Hi. Sorry for what you went through. Yes, you can get maintainance at any stage. The case can be filed under sec 125. Father is responsible to maintain wife & child even despite staying away since so many years.
