Domestic Violence and question regarding applicability of law

30-Dec-2023 (In Divorce Law)
We have a watchman who is a Nepali Citizen. For quite a few days, he is continuously beating his wife. The society management does not say anything. They say its a personal matter and we do not care. Isn't it domestic violence? I wanted to ask whether the domestic violence act in India will apply to him and whether someone else can file a case on behalf of his wife?

Well, you can definitely report crime of Domestic Violence happening with your Nepal Watchman's Wife, which is being committed by her own Husband. In India, anyone can report the crime happening around him or her. So it is not compulsory, that, everytime victim approaches Police or Court to report Crime.

Well, the Domestic Violence case applies on Nepali Cirizens too if they have been working in India. If a Nepali Mam is beating his Nepali Wife in India, she can knock the doors of Judiciary by filing a Writ Petition under Sec 21 of the Indian Constitution, to protect her Right to life from being violated.
