If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

You have already filed a DV case which will support your divorce petition. You can file a divorce case in the Family Court under Section 13(1)(ia) of the Hindu Marriage Act on grounds of cruelty, dowry harassment and forced relations. Your pending DV case will act as strong evidence. You may also seek maintenance under Section 24/25 HMA or Section 125 CrPC. In addition, you can pursue criminal remedies under Section 498A IPC for dowry harassment if not already filed. You need not continue this marriage if you do not wish to.

You already filed a DV case which strengthens your position. For divorce, you can file a petition under Sec. 13 HMA citing cruelty, dowry harassment & forced relations. Since marriage is under 1 year, you will need to seek court’s permission (leave of court) to file before 1 year. Simultaneously you may proceed with 498A IPC, 406 IPC & dowry laws for criminal action. You can also claim maintenance, residence & protection orders. Strong evidence of abuse will support your divorce and ensure your safety.
