Domestic Violance 25 Case Register at panipat case on 2020 December

I got the divorce from Delhi High court on the bases cruelty on 21 Sep 2023. 2020 my wife filled a DV 25 in panipat, my case is pending in arguments and from source I got to know that she married to another women news is confirmed but I don't have any proof how can I go further to stop interim mentainance, can I ask for affidavit from her.

You should file a new case under sec 146 clause 3 sub clause a of the BNSS ie new law which replaced CRPC but you need to have a proof before hand. Even if you ask her for an affidavit you must collect some proof because the burden of proof will always be on you.

You can successfully submit the certified copy of the divorce decree in the panipat court and orally argue that the matter is finished in 2023 and all the disputes between the husband and the wife are now finished. And the court will ask for your as well as her income affidavit and on that basis only maintenance will be decided.
