Domestic Dispute and False Cases

07-Sep-2025 (In Divorce Law)
My wife and I moved abroad a month after marriage. While there, I discovered her affair. Upon returning to India, she and her family assaulted me. I filed a police report NCR and a MLC. She has since filed false complaints against me with the CAW cell, alleging drug use, and has filed for maintenance and domestic violence. During counseling, she and her mother were violent and threatening. I have evidence of her affair.

From your description, you are in a stronger position legally (you have MLC + proof of affair). She is using typical pressure tactics (DV, maintenance, 498A threats). The key is to secure anticipatory bail in advance, strengthen your counter-FIR, and use her affair as a shield in matrimonial disputes.

Since you have already filed a Non-Cognizable Report (NCR) and obtained a Medico-Legal Certificate (MLC) regarding the assault, you should pursue that case to ensure her and her family’s actions are officially recorded. The false complaints filed against you can be contested during inquiry and trial by producing your evidence, including proof of her affair and records of threats. In addition, you may move for anticipatory bail (protection from arrest before charges are filed) to safeguard yourself from arrest in connection with her complaints. You can also file a counter-complaint for assault (Section 351 Indian Penal Code), criminal intimidation (Section 506 Indian Penal Code), and false implication (Sections 182 and 211 Indian Penal Code). She has approached the Crime Against Women (CAW) Cell and filed cases for maintenance (under Section 125 of the Code of Criminal Procedure, 1973) and under the Protection of Women from Domestic Violence Act, 2005. These cases can be defended by presenting your evidence, including proof of her affair and of the threats made during counseling.

Do seek a detailed legal Consultation from an Advocate having expertise in matrimonial matters. Do brief him and seek expert legal assistance. Get Your Cases Property represented before the Court of Law. File an appropriate reply / written statement to her petitions refuting all false allegations.

You have strong legal grounds to contest her false allegations. Since you already filed an NCR and MLC, keep certified copies safe as evidence. For the false complaints at CAW Cell, you should present your version along with proof of her affair and medical/legal records showing assault by her family. Her allegations of drug use must be challenged through clean medical tests and rebuttal evidence. You can file a divorce petition under Section 13(1)(ia) HMA on grounds of cruelty and adultery, supported by your evidence. Additionally, you may seek to quash false FIRs under Section 482 CrPC and defend the maintenance case by proving her income, misconduct, and your evidence of infidelity. Document every threat or violent act by her and her family. A strong defence along with a counter case will protect you legally.
