Does child born from extra marital affair have any rights
12-Jan-2023 (In Divorce Law)
i have a child with my extra marital affair. what are his rights and can he claim something from my property.
Yes the child has full right.
Irrespective of the fact that whether the marriage was solemnized or not the child born out of certain relationship has right/claim over her/his biological parents property. In his parents' property he has same right/title/interest as he would have in case of from the wedlock of marriage. But the same rule is not applicable in the case of property of his/her parents spouse. He has right to maintainance etc.
Yes he has all the rights which a legimate child could have only the thing he has to prove that u are his biological father . for example you may take ND Tiwari congress leader case. Moreover if he not legimate in this it is not his fault that's what court prosume so .hope you must also think in that way
