Do we need to close the previously filed contested divorce before filling the mutual contest or need to keep the contested divorce as kept away can continue fresh mutual divorce
Dear Sir,
You need not to close previous divorce case if you wish to go for mutual Divorce. You have to file compromise petition under relevant provision of CPC that is order twenty three rule one of CPC. Both of you must sign the said application and affidavit. The divorce decree will be granted in terms of compromise thus the divorce case will be closed and decreed in terms of compromise only. You need not file separate mutual divorce case.
