Divorcee for hiding past affair and still wanting to be in touch

09-Oct-2023 (In Divorce Law)
Hello, Can I get divorcee in case my husband has hide his past sexual extra marital affair, while we were in 2 years of relationship.. they broke up before we both met due to that woman's another extra marital affair (both were married) and the other hand after a year later, he continued his friendship with her (which I think might be sensual) without my knowledge as well despite I found out and asked to stop communications, he kept lying and continued... I find this offensive and insulting... And feel he had played with my life... Although he says he loves me... But I don't think so and as well I have no love left for him.. can I easily get divorcee on this basis and start my new life... We both r 30+.. currently I don't have any proof of him having sexually involved after marriage. But if court orders to find out, those details can be retrieved from his chats and call records... Please help me.. as I find myself isolated at place where I never wanted to be..

This is my response to you:
1. You will have to file for divorce under the grounds of cruelty and adultery;
2. Tell the court there is irretrievable breakdown of marriage;
3. Decide the alimony and waive off the cooling off period;
4. The divorce will be contested divorce;
5. If your husband is ready to go for mutual consent divorce then do the same (smoother process);
6. Consult a local lawyer and take steps.

Dear Quereist, As per your query you have asked your husband to sign a legal document for not communicating with the lady with whom he was having affair and to secure your rights to get divorce if he acts again the same in future. You can definitely have right to file a divorce petition on the same grounds.
