Divorce rejected after 8 years in lower court. HC Fast-track possible?

08-Apr-2023 (In Divorce Law)
Hello Sir/Madam, My divorce plea was rejected after 8 years in the lower court. I am planning to challenge in HC. Is there a way to fast track or I will have to wait for judgment for another 3-5 years, till I am 45 years & my life's golden years are lost. Is there no means for the marriage to be stated as void, when we are not together for more than 8 years? Is there no way I can remarry? Can I change my religion from Hindu to Muslim & remarry? I am feeling dejected.

lf your advocate feels That the lower courts judge ment is not fair you can challenge it in High Court . you can push the case by filing memo. Now Indian Law is such that you cannot escape it by changing reiigion.

You can file an Appeal in the High Court. The case in the High Court would move relatively faster as there is no Evidence/ Cross-examination. Your petition should be strong, and you need to file the documents from the Family Court and submit Arguments. If the divorce was rejected, you are still married, so you cannot remarry. Change of religion to muslim will attract more problems for you as your wife may take that matter to Court.
