Divorce query concerning child custidy

Now that adultery is not a criminal office, how does it affect child custody. If both the parties prove that the other partner was adulterous Wil it affect child custody in anyway

Dear Queriest, custody of a child has no concern with Adultery, because it will only depend on the fact that who is able to uphold the willingness and taking good care of the child, secondly the court if filed for custody of the child the Court will decide on the facts and circumstances for the same.

This is my response to you:
1. Adultery may not be a criminal offence, but certainly is a ground for seeking divorce;
2. It certainly can affect, the custody of the child;
3. Especially, if your partner or her partner is not someone you or your wife would want to associate with the child then objections can be raised;
4. If either parent has been careless or negligent the court may award the custody to the parents of either spouse;
5. Also there will issue if visitation rights;
6. Consult a local lawyer with full facts of the case.
