In India, obtaining a divorce when your wife is unwilling to cooperate (a contested divorce) is possible, but the process is more complex and time-consuming than a mutual divorce. The grounds for divorce and the procedure vary depending on the specific laws applicable (Hindu Marriage Act, 1955; Special Marriage Act, 1954; Dissolution of Muslim Marriages Act, 1939; etc.). You need to determine which Act governs your marriage. Please contact to lawyer for more details. Disclaimer: This information is for educational purposes only and does not constitute legal advice.

For a contested divorce, you need to file a divorce petition in Court. However, if your wife subsequently agrees for a divorce then the same can be converted into divorce by mutual consent. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Yes, there are several grounds mentioned under the Hindu Marriage Act, 1955 based upon which, you can seek Unilateral Divorce like Adultery, non justified Desertation, Indicimg Separation of Husband from ailing Parents, etc..
