Divorce per muslim law without consent

19-Mar-2024 (In Divorce Law)
Hello, I was married in Hyderabad with with a local living in Canada. She had later sponsored me to migrate to Canada and we both are now Canadian citizens. Unfortunately, our marriage did not work out and we have spend 5 years together. She decided to separate and send me Khula affidavit to sign. When I refused to sign and asked her to have a professional counsellor in between, she has threatened to file a case against me. What are my options? Thanks!

Your wife may file the case in Canada as well. Just because you got married in Hyderabad, it doesn't mean that divorce also should be done in Hyderabad only. As you both are Canadian Citizens, I strongly believe that she will be filing the case in Canada, not in India. But Yes, she has got the rights to file anywhere. She can file a case even in Mumbai if she visits Mumbai for a couple of months even though you have roots only in Hyderabad, India and Your city, Canada. You may have to fly to Mumbai to defend your case. She can file a Divorce case anywhere. Once she makes the first move, hire a local lawyer of that jurisdiction. The lawyer will give you the options.
