Divorce maintenance one-time settlement

Hindu. Left husband 5 yr back for mental harrasment by him& MIL no child. He neglected me in his house never came to patchup never gav maintenance till now. I gav my money to build his parents house. No case yet done. I hv no job,less study. *Till 5 yrs he didn't try patchup, can he file rcr now? *What if he falsely say I deserted no reason? *How prove indirect mental cruelty with no recordings? *He spent my money, I hv no proof. I want my right&justice. What shud i do & what can he countercase?

Mere delay or prior separation does not bar relief. If cruelty, neglect, or denial of maintenance is continuing, proceedings may be initiated under the DV Act, Section 125 CrPC, and appropriate divorce proceedings on grounds of cruelty and harassment as applicable.

if you have left your husband and you are seeking maintenance, you need to file for a domestic violence application and seek maintenance if you want to get remarried file for divorce and seek alimony if you want share in his ancestral land or you need dyour spent money back or common property file for civil case, if you want to go back to him file for restitution of conjugal rights before filing any thing give him a legal notice for it. He cannot file anything other than the above except the domestic violence case, which cannot be filed by husbands.

To file case in family court, you need to have proof of cruelty either recordings or neighborhood testimonials. Second for money you spend or given to him must be proved with transfer statements or any other kind of proofs. To get Alimony you must prove that he is treating you cruelly. Meet advocate practicing in family court near to your location. and apply for interim maintenance.
