First send her a legal notice for mutual divorce . If she agrees then fine otherwise file for contested divorce. If you want her to get back then file for section 9 under Hindu marriage act for restitution of conjugal rights.

divorce ka ground hai aapka aur ismein divorce file ho jayegi kis tithi se aapki Patni aapse alag ho rahi hai chij ko mention karna hoga aur kis Karan Se Alag Rah rahi hai kya vah Wapas nahin aana chahti ya koi cruelty hai jo bhi sari chijen Hain ine Sabke base per aapka divorce file ho jaega

Aap divorce file kar sakte hain agar aapki wife bina wajah 1 saal se zyada samay se mayke me reh rahi hain aur aap dono ki baat-cheet band hai. Yeh ground “desertion/mental cruelty” ke roop me court me manny hote hain. Aapko Family Court me divorce petition file karna hoga. Court pehle counselling aur mediation ka mauka degi. Agar samjhauta na ho, to divorce decree mil sakti hai. Bacche ki custody aur maintenance ka faisla bhi isi case me hota hai. Isliye apne saboot (messages, witnesses) ikattha karke case file karein.

Bhai aap kahan rahte ho or biwi kahan rahti ha. divorce to ho jayega lekin pahle ye batao ki abhi rahte kahan ho or bacha kiske pas ha. kya biwi bhi apko divorce dena chahti ha. aap dono ke bich me dispute kya ha.
