Divorce from Egyptian Spouse (Male)

31-Dec-2023 (In Divorce Law)
I am writing to seek guidance on a legal matter concerning my divorce from my Egyptian husband. I am an Indian national. The divorce was granted in absentia in Egypt, and the marriage was solemnized exclusively in Egypt without any registration in India. I used to live abroad, but I have recently moved to India during our separation. We are Muslims. He notified me over text and I await the papers now. It's okay for me to accept this divorce. Do I need to legalize it here? And how?

If you do not want to challenge the decree and the time for appeal is also lapsed, then it's valid. You don't need to get it registered in India. Also if your marriage was registered in India you will need to file an application to deregister your marriage. if you want you can get the decree attested by the Egyptian embassy in Delhi as well so that it is a proof to be submitted to the Sub Registrar for registration of your marriage in govt records.

as you mentioned you are india citizen and the divorce had took place abroad. the divorce decree has to be executed in india than only that decree will be valid in india. execution process has to filed in court and court will check the process and authencity of the decree. than that decree will be legal in india.

Respected ma'am In order to get your divorce legally enforceable here in India, you need to file a civil execution suit in the family court of your concerned jurisdiction in India. You may consult me in that regard. thanks!
