Divorce for brother who is suffering from since 2017

My wife has put fake case in 2017 dv and crpc and in 2021 she took 25 lakhs rupees for kids and case was closed ..dv was closed itself ..later she filed case in police station saying that she was raped by putting 377 and other forgery cases and now when I had put divorce case she again filed fake things like we were saying together when we have never stayed together after 2020 and in aug 2023 it gone in her favour that we were living like husband wife when she was statinh in other city..

It's regrettable that you opted to pay such a huge nt to resolve those cases instead of pursuing a divorce by mutual consent. Now, she retains the option to reopen those cases, and in the divorce proceedings, you may be liable for alimony as per Indian matrimonial laws. These realities are indeed harsh. However, you have recourse. You can file a counter case against her for criminal intimidation. Additionally, it's essential to clarify that Section of IPC does not constitute rape, so it's crucial to maintain composure and perspective amidst these legal challenges.

You have to still prove that case in your favour as the burden of proof shits to you, once the complaint is filed. However she also needs to prove all the allegations she is making against you. You need to fight this case diligently to avoid any conviction. So my advice is to you, to let the chargesheet get submitted and then file a discharge application along with all the proof that you have against this false complaint.

You can go in appeal and also seek quashing of the case with substantial evidences in your favour. Needless to say, what you need to bear in mind is that you will have to convince the Court beyond reasonable doubt. And in this case over and above, because you have already lost in the lower court.

Ur case is going out of track because of misguided advice I dot know why u pay 25 Lacs in DV case without any agreement and why u did not do divorce at that time free to call or text me back when you need guidance
