If your wife intends to file a divorce petition for no valuable reasons, you file a petition for restitution of conjugal rights before her. As far as maintenance is concerned, that will be decided on your economic status and earnings.

hi alocious here, from your query I can well understand your grievance, when your wife files for a divorce, which I believe is imminent considering you both staying apart with a resolve to remain separated, firstly notice would be corresponded to you, followed by proceedings for divorce, you will have to represent the case with an eminent advocate, issues such as maintenance and alimony will have to be sorted, she will file petition seeking about your properties and assets which will have to be disclosed following which court will award alimony, and in the event of hee filing a police complaint against your parents legal actions will be taken against them, kindly contact me back to discuss on the possible solutions to your current scenario, thank you regards, Alocious Felix Pandian G S

if you are going to get your divorce by the way of mutual consent then three things should be decided before the filing of mutual consent divorce first what is the maintenance amount whether you are giving on a permanent alimony basis or monthly maintenance and the quantum of the maintenance should be also decided before filing the divorce petition you have said that is no children so no maintenance on the part of children but if there is any articles or jewellery belongs to your wife and she is claiming back then you should return the same as reciprocal on both the sides if there is any property purchased in joint name you should decide whether one party is going to release the rights or going to divide the property that should be decided in the mutual consent petition you have said you are separated for many years so you can use the benefit of the supreme court judgement and get your divorce between 15 to 20 days
