Divorce either on (i) mutual consent (ii) Mental torture
23-Apr-2023 (In Divorce Law)
We are Hindu and married for 29 years. For the last few years I am not getting along with my wife. She has become very aggressive and starts a quarrel now and then unnecessarily with small and insignificant matter and life has become unbearable. From her attitude it looks like she may also agree for mutual divorce. My children are grown up and independent.I am not adverse to paying her alimony. We stay in the same house. How can I obtain a divorce at the earliest. Please help.
The easiest way to get a decree of divorce is filing the suit on mutual consent. A prerequisite for filing a suit for mutual divorce is a separate living of minimum one year. After filing it would take a minimum period of 6months to maximum 18 months.

Hello,
You should file a mutual divorce petition. Then within six months you will get divorce. Before that you both need to sit and decide all terms and conditions. And then approach a lawyer who can file the petition before the competent forum. You may contact me for the assistance.

If both are willing to take Divorce in Mutual Consent. Then file a Divorce application U/s 13B of Hindu Marriage Act through an Advocate before the Ld. District Judge of your District. After filling the same wait for 6 Months and thereafter Reconciliation Date was given by the Hon'ble Court after that, Final Hearing will be held. It is the procedure of Mutual Divorce.
