Divorce due to medical condition

I was married in 2012 , and I have 9 yr son I was treating my wife for past 10 years for lupus and I came to know that she is having this issue from before marriage . Pls let me know whether can I divorce my wife without any maintenance and take custody of my son

hi alocious here, I can well understand your concern from the query raised, kindly ponder over the divorce as lupus condition alone cannot constitute a ground for divorce, but if the same had been concealed at the time of marriage like you had said, it shall be construed as a ground for divorce, thank you, you can contact me for further clarifications, thank you

Maintenance could only be refused in cases where the wife has indulged in an adulterous relationship or she deserted the husband without any valid reasons. In all other cases the maintenance has to be paid to the wife irrespective of the religion.
