Divorce & child custody of daughter

26-Jul-2023 (In Divorce Law)
My wife & I got married 12 years ago in India & the marriage is registered under the Hindu Marriage Act.I am a father of 5 year old daughter. All 3 of us are NZ citizens living currently in Australia. All 3 of us have also obtained OCI.My daughter is NZ citizen by birth.Wife has tortured me emotionally for 10 years & shown immense disrespect for my family including during my father's last rites.I want to fight for joint custody of child. Is this possible in India or should I fight in NZ/AU?

Dear Sir, Since the daughter is the citizen of NZ so most probably the child custody case is to be filed in the same Country. The Indian Laws says that child custody case to be filed within the territorial jurisdiction of the child where ordinarily resides.
