Relgion Christian marriage act. after 2 years of marriage My friend Mr Xaviour vinodh has filed a divorce case in chennai family court, marriage happened in chennai, after court councelling Vini Wife of Mr Xaviour Vini has filed a transfer case to her native place Thanjavur, now the status of case is dismissed and disposed. DECRETAL ORDER from thanjavur 1. That the petition be and the same is hereby dismissed for default. 2. That there is no order as to costs. Case Status: CASE DISPOSED Nature of Disposal: Uncontested--DISMISSED Business : Petitioner not present.No How to retransfer the case to chennai highcourt...what is procedure to be done in thanjavur court to retransfer from the boy side. as chennai court only put the dates for every two month or three months and says action to be done from thanjavur side. Notes- Vini is 8 years elder. In the marriage certificate Vini has given dob 3 years younger than mr xavour giving ration card, pan card, comp id card.

This case can be transferred to Chennai for that we need to file casein Chennai high court for transfer of original petition supposed to be filed. Then if you haves the merits then court will order for transfer

Thecase has been dismissed for default. If you want to pursue the case you have to restore the petitiion in Tanjavur court. Since the wife filed the transfer petition and it was allowed it would not be possible to retransfer the case to chennai. If you want to contest the case you have to go and conduct the case in Tanjavur.
Why did your friend not attend the hearing in Thanjavur? Did he not know about the transfer of the case? Did he get notice from the Madras High Court in the transfer petition? Anyway 1st he has to file a petition in the Thanjavur court to set aside the order of dismissal and restore the case to file. He cannot transfer the case to Chennai again. Maybe if you tel me all the details I can advice you if it is possible to once again transfer the case to Chennai.
