Divorce Case for my mom. Inherit husband property.

My mom is 56 years old. My father is cheating on her with a young girl. Now my mother wants divorce. My question is. If I apply for a foreign country immigration. For myself, my wife, my son and my mother. Do my mother need to be legally divorced before. Because if visa process requires any sort of formalities from my father, he would not come. Because we as a family have lost contact with each other. He is living with his mistress and my mother is living with us. So does she need to be divorced

it would depend upon immigration rules of the specific country. if you would apply for her immigration as only a mother then no need and if as a dependent, then to show her dependence on you, she would require divorce.
