Divorce Case Approach when Girl is not Ready

We have informed girl's family quite clearly that we need div but they are not willing. They had insulted me, my mom very badly, accusing me with physical abuse, she is not satisfied with physical interaction, blaming me for ill health, wants to separate me from my family, not taking care of any family responsibilities. We met doc and doc certified my good health and asked her for counselling. I want to start my new life with some one else, I cant waste my life like this. Last 1.5yrs we staying separated and got married total for 3yrs. Please help me with suggestion how to get separated.

Not sure whether the girl is also willing to apply for divorce.
normally if the divorce is not by mutual consent, then women normally file the following cases
a) criminal case under 498A and Sections of Dowry Prohibition act.
b) criminal case under Domestic violence act.
c) criminal case for maintenance under section 125 Cr.P.C
d) Suit for partition of properties that are in the name of Husband and
e) Suit for Divorce.
please be informed that even if the woman is very good and is agreeable for mutual divorce, her relatives and lawyers will ensure that all / any of the above cases are filed against the husband so as to harass the woman and also cause financial hardship to the husband.
also you need to have your finances (up to 6 lakhs minimum) ready in place before even initiating steps for divorce.
i do not mean to dissuade you, but advising you on what are the consequences in the event of you filing for divorce.

HI,
sir if girl is not ready to give divorce to you can't do anything. if she agreed for divorce both of you file U/S 13-B of hindu marriage act for divorce which is very easy procedure. if she is not ready for divorce she can file 498-A, dvc and other cases against you. it's better for you to file divorce against her under hindu marriage act in the family court. it will save you to some extent.
