Divorce Basis Desertion Ans Cruelty

If i relocated to another city for job with spouse permission from a city where he was not staying .he stopped taking my calls and forcibky shifted my luggage to his city at west Bengal in my absence, can he prove i deserted him. As hes telling everyone that i left house on his absence. He also threatsns me not to call him again when i cakl for money since my salary isnt enoufh to pay emis for personal loans which he forced me to take. He claims that he has been paying emis for joint apartment with both of us as co applicants in home loan. Hes pressurising me to sign power of attorney so that he can pay off hus debts. He says as he is paying emis i dont have any right in property thoufh we are joint owners. How to disprove that i deserted since i relocated for job. Am i liable to pay him his contribution for emis and then only i will be legal owner
if you have any proof that he has thrown you out of the house then you can challenge him in the court. however at the time of filing the case the court does not know what is the real story so his case will be accepted. this is the reason the court sends you the summons so that you can also come and give your justification.

Hello ma'am. I have perused your query. At the outset your husband cannot force you to sign a PoA. Further, to establish desertion he would have to show that you withdrew from his society without reasonable cause against his consent. Relocation for professional reasons does not fit the bill. first, you can submit transfer petition incase you relocate the city for job.
2nd, he cannot relocate or shift your belongings without your knowledge, thus you have to make a police complaint for the same. on same time to Court too.
3rd you have full rights in same property, incase you are a co applicant but make sure your registration should be completed as well.
4th, you are not liable to pay the emi, untill unless he fails to pay, there are few certain things involved, like bank agreement and guarantor, without knowing I cannot suggest further information.
