Divorce and Property settlement

11-Mar-2026 (In Divorce Law)
Hi There, I am planning to get divorce from my husband. We are married for 15 years now. Since the date i got married, I have given all my salary to my husband and his family. My husband is claiming that he doesn't have money. All the properties that we bought till now are under his name. I have evidence of my bank transactions for the last 15 years. What is the amount that I can get back legally from him? I was thinking of 75% of money that I earned with bank interest. is it possible?

From the facts stated, the law does not automatically grant a fixed percentage such as 75% of your earnings merely because the properties are in your husband’s name. However, if you are able to establish through bank records and financial evidence that your income was consistently contributed towards acquisition of assets standing in his name, the court can certainly take such contributions into consideration. In matrimonial proceedings, you may seek maintenance, permanent alimony, and also claim a beneficial interest in properties acquired during the marriage if your financial contribution is proved. Courts have recognised that a spouse who has financially supported the family or contributed to acquisition of assets cannot be deprived merely because the property is registered in the other spouse’s name. Your 15 years of bank transaction records may become crucial evidence to establish financial contribution and economic abuse. Therefore, the appropriate legal course would be to seek divorce along with claims for permanent alimony, financial compensation, and assertion of rights over properties acquired during the marriage, depending on the evidence available.
