Divorce and child custody - passport for child

03-Oct-2023 (In Divorce Law)
I am from Tamilnadu and currently residing in bangalore.I had filed for divorce and maintenance case. I have 8 year old daughter. The case is proceeding very slow and not progressing well. I am a working women and I am not expecting any maintenance for myself. But my lawyer is advising to get for my daughter. Recently I moved to different position and my job requirement is to travel abroad for few weeks to months frequently for training and meetings. But my daughter don't have passport. I have applied for a passport for her in bangalore, but the passport officer closed it requesting consent from father or interim order from court. I am worried to leave her alone here. Last time I left with my sister, but she was not taken care off properly. I want to take my daughter as well when ever I travel. Is there any way to get this issue resolved?

Dear Madam, As advised by the Passport Authorities you have to file child custody case and get interim order of the Court to take your daughter to Abroad alonv with you. Secondly, you can file maintenance under Section 125 Cr.P.C exclusively for your daughter and your husband is bound to give such maintenance to the extent of 50% of total expenditure incurred on your daughter.
