Divorce and Child custody of 6year girl

I opt for divorce under cruelty my daughter is 6years old and she is citizen of US but from 3.5 years she’s in India and I moved to India 1.5years and filed for contested divorce nd my husband who’s in US refuses to give divorce also filed Guardian and ward act sec 7. My question is 1) how long it’ll take for contested divorce if he refuses to sign/ accept ? 2) He filed guardian and ward act stating that our family is financially weak will custody goes to him?

as a guardianship first preference given to mother and as you said ur husband is not in India and coming to contest divorce we don't need any sign or accept ...even though u get divorce ...u need to opt a good lawyer
