08-Apr-2023 (In Divorce Law)
My husband claim a case against me in court that he wants divorce from me. He claimed that am not coming for married life. Actually he dropped me at my home 17 months ago without any reason after that he raised some internal clashes and left me at my home.i went for Police station and they gave upto 4 councellings.eventhough he refused to accept me. At the time of councellings he went to court for divorce with his private lawyer. Actually am always ready to go but his not accepting me and reversely he went to court for divorce and saying that am not coming to married life since one year. Please give me a suggestion to proceed further.

Dear Client,
You must project your case before the judge, whether your husband filed a case for divorce. Whether you got summons from court. If not enquire whether has he filed a case for divorce or not. Court will not grant divorce to your husband without hearing you. You need not worry. Take expert legal assistance who deals with divorce cases.

Hi
You can resist the divorce petition in the court stating that you do not want divorce and instead submit a prayer to the court to dismiss the divorce petition and direct your husband to take care of you .
Also if you can get the police counselling records and submit the same along with your counter for divorce petition, the same will be treated as evidence by the court and courts will ask your husband to resume marital responsibilities.
If your husband refuses to live with you, courts will grant you hefty alimony and direct your husband to pay the same .
In addition to alimony, courts will also direct your husband to grant a share of his properties to you for his failure to resume marital responsibilities.

It is not easy to get divorce for a male under indian laws, If U contest the divorce matter it may decide on merits, U have a chance to file a criminal case u/s 498A of IPC against ur husband and her family If they demand for extra dowry. In my opinion settle the issue through mediators is a best option for both of U
