Divorce after 1.2 years of marriage according to hindu marriage act
21-Aug-2023 (In Divorce Law)
I am married for one year 2 month and looking for dissolving the wedding. There are a lot of cultural and thought clashes between me and my wife. We both are completely different personality and we tried to adjust a lot and compromise. I don't see a healthy future with her. I want to file a divorce petition. on which ground can I ask for the divorce??
Hi...if you both are ready for divorce then you go for mutual consent by that you can get divorce within six to eight months and if your wife is not ready for divorce then you have to file contested divorce and it will take more than two years to dissolve your marriage.
Thank you
Thank you
Divorce among Hindu law is granted by Court by two modes
One is by either spouses by Judicial Adjudication U/s. 13 (1) of Hindu marriage act. On grounds or cruelty or other grounds mention in the said provision.
The other grounds is by mutual consent by both spouses U/s. 13 B of the act.
For presenting Any case under section 13(1) one year after marriage should have been lapsed
Whereas in case of sec 13B after marriage both spouses must have been living separately apart from lapses of mandatory period of on year
Any how an exemption u/s 14 can also by claimed for presenting the divorce petition within 1 year under both sections
Hope I have answered your case

Hi
If you are looking for mutual divorce as per Hindu Marriage Act, then you can put forth ground for dissolution of marriage by claiming life style difference and general differences in thoughts and decisions.
